In NSW the components of an advance care plan are:

  • Enduring Guardian – legally appoint a substitute decision maker under the Guardianship Act 1987. Must be in the approved form.
  • Advance Care Directive – to provide specific information relating to your wishes, values, and any treatments you would not wish to receive. Can be on a form, or in some other way, for example a letter. Supported under common law.
  • Statement of Values and Wishes – to record your wishes regarding future medical treatments, to inform your substitute decision maker and doctor.

In Victoria the components of an advance care plan are:

  • Enduring Power of Attorney (Medical Treatment) –  for appointing a substitute decision maker
  • Advance Care Plan/Directive – for documenting your wishes to inform your substitute decision maker and doctor in making decisions for you.
  • Refusal of Treatment Certificate – in relation to a current condition, for legal refusal of medical treatment generally or of a particular kind.

In Queensland the components of an advance care plan are:

  • Enduring Power of Attorney – to appoint a substitute decision maker
  • Advance Health Directive – a legal document where you can record your wishes regarding future medical treatments. There is an approved form that can be used, although it may be in another form.
  • Statement of Choices – to record your wishes regarding future medical treatments, to inform your substitute decision maker and doctor.

Enduring Power of Attorney short form – for appointing the same attorney(s) for both financial and personal matters, or for appointing an attorney for only financial matters or only personal matters

Enduring Power of Attorney long form – for appointing different attorneys for personal matters and financial matters

Western Australia

In WA the components of an advance care plan are:

  • Enduring Power of Guardianship – to appoint a substitute decision maker
  • Advance Health Directive – to legally record your wishes regarding future medical treatments.
  • Advance Care Plan – to document your wishes to inform your substitute decision maker and doctor to assist them in making decisions for you.

South Australia

In SA a person can complete an Advance Care Directive, which can include the following components:

  • Appointment of a substitute decision maker
  • Documentation of healthcare wishes, including refusals of healthcare.

Statutory documents completed prior to 1st July 2014 under previous legislation remain valid. These include Enduring Power of Guardianship, Medical Power of Attorney and Anticipatory Direction.

In the ACT the components of an advance care plan are:

  • Enduring Power of Attorney (EPA) – to legally appoint a substitute decision maker
  • Statement of Choices – to provide specific information relating to your wishes and values
  • Health Direction – to legally refuse medical treatment generally, or of a particular kind, to be withheld or withdrawn.

In NT an Advance Care Plan is referred as an Advance Personal Plan. The components of an advance personal plan are:

  • Advance Consent Decisions  – legally binding statements about your future healthcare
  • Advance Care Statements – about your views, wishes and beliefs as to how you want to be treated in related to any future health, financial or lifestyle matter
  • Substitute Decision Maker(s) – to make decisions on your behalf

Tasmania

In Tasmania the components of an advance care plan are:

  • Enduring Guardian – to appoint a substitute decision maker
  • Statement of Choices/Advance Care Directive to record your wishes regarding future medical treatments, to inform your substitute decision maker and doctor to assist them in making decisions for you.
